Assignment

  • There is only an assignment if you agree to my offer and I confirm the assignment in writing.
  • After agreeing to the offer, I will send you an invoice for the down payment of 35%.
  • The offers, prices or discounts apply for that moment. So you cannot derive any rights from it in the future.
  • As soon as I’ve received the down payment (the delivery time starts now), I’ll get started with the drawing.
  • Once the drawing has been delivered, you will receive an invoice for the remaining amount of 65%. The payment term for tailor-made drawing is 14 days.

To work

  • After receiving the deposit, I start drawing.
  • I put the drawing in a rough sketch. And work out the details in pen.
  • To give you a ‘look behind the scenes’, I take some photos of the process and send them on. (Sometimes work goes fast and you get all the photos at once, sometimes it goes in stages).
  • This is not intended for you to indicate wishes. The creative process is down to me, hence the importance of an extensive briefing at the start.
  • When the drawing is ready, you’ll receive it from me in the manner agreed in the quotation.

Intellectual property

  • After purchasing a drawing (in whatever form) it is your property.
  • However, I always (unless otherwise agreed in writing) hold the copyright to all my work. As a result, you may not copy, edit and / or create and distribute the drawings without my permission. Such as, for example, the use on folders, cards, flyers, logos and other communications or merchandise.
  • Only after written confirmation and payment, you will have the exclusive right to publish drawings as described in the written confirmation. If you want to use the drawing more often (reprint or extra material) or if you want to use the drawing in a different form than agreed in the written confirmation, please contact me at marlies@tosparkle.com to agree a fee.
  • You can share a photo of my work on the internet (e.g. social media, email to friends) by stating my name (@marliestosparkle). Would you like to use my drawing for something else or are you unsure about its use? Please contact me (marlies@tosparkle.com). Then we will discuss the options.
  • I reserve the right to list the drawings on my online portfolio and use them for promotional purposes and in / on other products.

Prices and payment

Webshop

  • I communicate the prices of the posters and postcards at www.tosparkle.com.
  • Prices always include VAT.
  • It is stated per poster/ drawing whether the frame is included.
  • On my website you can pay online via iDeal. You pay prior to shipping.
  • The prices are without any shipping costs.
  • The offers, prices or discounts apply for that moment. So you cannot derive any rights from it in the future.

Tailor-made

  • I am happy to make a (non-binding) offer for tailor-made drawings.
  • The offer states whether the frame is included.
  • Prices always include VAT.
  • The prices are without any shipping costs.
  • After agreeing to the quote I will send you an invoice for the down payment of 35%.

Order procedure online

  • You place orders via the webshop and you can arrange payment via iDeal.
  • You will receive a confirmation by e-mail.
  • The invoice is sent by e-mail and not by post.
  • Pre-orders will be shipped as they become available. If you have placed an order that consists of multiple products, the products in stock will be shipped immediately. Unless the expected delivery time of the pre-order is 3 days, then I will ship everything in one go.

Reflection period

  • Only if you have made a purchase in my webshop, you are entitled to a reflection period of 14 days. If you give me a tailor-made assignment, you are not entitled to a reflection period.
  • The reflection period starts when you receive the order.
  • Within those 14 days you can contact me by mail (marlies@tosparkle.com). Then we agree on the settlement.
  • After I have received the (partial) order, without damage, the money will be refunded to the account within 14 days.
  • The costs for returning are at the expense of the customer.

Shipment

  • The products bought in the webshop are shipped in 500 grams recycled cardboard envelopes. Size 31.5 x 24 cm and fits through the letterbox.
  • Packages are packed with care.
  • I ship via PostNL. Via Track & Trace you can see where the package is located.
  • Any import duties and taxes payable are for the account of the customer.
  • I am not responsible for the services provided by PostNL and international mail.
  • PostNL only offers (partial) compensation if a postal item has been sent by registered or insured mail.

Not happy

Webshop

  • Did you receive something different than you ordered? Apologies, my mistake! Please send me a photo of the delivered material by
    marlies@tosparkle.com I can then verify this with the order. The ordered material will then be delivered at my expense.

Tailor-made

  • Tailor-made: if it’s good, during the briefing you have told me all the details that are important to you. And I’ve asked as many questions as possible to find out. Since it’s a ‘one of a kind’, drawn by hand on paper, I cannot erase or move anything.
  • In the unlikely case that something is not to your liking, let me know. Then we search together for an appropriate solution, within the ‘limits of fairness’. Not finding something ‘beautiful’ falls outside that scope. If I really made a mistake or missed an important part of the briefing, it’s a different story. Then we look for a suitable solution.

Shipment

  • Is your package damaged or has it not arrived? How very annoying! Unfortunately, I am not responsible for the services provided by local and international mail. PostNL only offers (partial) compensation if a package is sent by registered or insured mail.

The ‘store’

  • To Sparkle is run by sparkling me. Everything is handmade and processed with love and attention. My aim is to process your order asap. However, you cannot compare me to large mail order companies.

Force majeure

  • To Sparkle is not liable if an agreement cannot be executed in case of force majeure.

Law of personal Records
We respect your privacy and will not provide your information to third parties.

Validity of general terms and conditions

  • These terms and conditions apply to all assignments I carry out, quotations I issue and offers I communicate. Or where it is stated that these general terms and conditions apply.
  • Deviations from these general terms and conditions are only valid after we have agreed this in writing.
  • If any part of these terms and conditions is no longer valid (for example, by law), the other provisions of these terms and conditions will always remain valid.
